Can you ask the Compensation Commissioner to reopen a COID claim?

The Compensation Commissioner will give your employees compensation for an injury on duty that stops them from working for three days or more.

This could be, for example, if your employee has a serious fall and hurts his back. If this injury stops him from working for a year, COID will pay him compensation.

But what if, once your employee returns to work, he starts feeling extreme pain in his back again and asks to see the doctor?

This is the point when employers ask if COID will reopen their employees Injury on Duty (IOD) claim...

Can you ask for claim IOD claim to be reopened?

 
Yes! You can definitely ask the Commissioner to reopen a IOD claim. The only rule to remember here is you can only ask to reopen a claim if your employee is:
 
- Still experiencing pain or discomfort because of his original injury;
- Has to go back to the doctor because of his original injury; and
- If the doctor books him off or treats him again because of his original injury.
 
So let's look at the example of the employee that hurt his back. His original injury was to his back. If that injury still causes him pain, or he has to have further treatment, he can ask for more compensation under the same claim.
 
So here's what you'll need, to ask the compensation fund to reopen this IOD claim for more workers' compensation.

When you apply to COID to have your IOD claim reopened you'll need:
 
- The original case reference number (W.CL.55);
- A letter from his doctor stating his present condition;
- A letter from his doctor stating his present condition is relation to his original condition; and
- The nature and extent of treatment he proposes to improve his condition.
 
If you can motivate your claim effectively, COID will reopen it and pay out further compensation.
