And with a lot of companies introducing free WiFi, many employees abuse this company perk that's meant to help them do their jobs better.

Recently, we've been seeing a lot of cases where employers are complaining that employees are using free WiFi for things that have nothing to do with the job. This includes sending and receiving porn.

The question that follows these complaints is whether or not this is disciplinable conduct?

You can take disciplinary action against an employee who sends or receives porn at work because this constitutes misconduct. It doesn't matter if the recipient had no objection to receiving the material.
 
You have every right to act in this case.
 
As an employer, you're entitled to expect your employees to use company assets for company purposes. It's not to the benefit of your company for your employee to use company PCs and the Internet to transmit pornographic material, says the Labour Law for Managers Loose Leaf Service.

If, for example, you have policies and procedures that make it clear that you adopt a zero tolerance attitude towards the transmission of pornography or any undesirable electronic information, you can dismiss your employee for this offence.
 
Just make sure you follow a fair dismissal process, like holding a disciplinary hearing.
 
If you decide not to dismiss after the hearing, you can issue a final written warning, especially if it's the employee's first offence.
 
There you have it. You can discipline an employee if he sends or receives porn at work. Just make sure you have clear policies and procedures in place so employees know you don't tolerate this conduct.
