According to specialist attorney, Russell Luck, an employee who bad-mouths you can, under South African law, be liable for damage claims and even dismissal!
You see, the legal relationship between you and an employee is one of good faith, and so there's no reason for you to keep an employee on who's tearing your company's image up from the roots. Instead, you as the employer may dismiss
the employee for any bad comments on social media
But be warned that this doesn't apply to if the employee is speaking the truth, regardless of how negatively their comments affect your company's image. If you dismiss
an employee for exposing the truth about you, then they will able to turn the tables and claim damages from you.
So before dismissing an employee, make sure you're in the right, and that you're not trying to cover an inconvenient truth. Because if you do, you'll end up paying for it!
