Here's what to do when an employee takes two days' sick leave every month

The question our labour experts received is as follows:

'I have an employee that takes two days' sick leave every month on various days of the week. She does produce a doctor's note, but we would like to know if there's anything we can do to break this trend.'

Our experts at the Labour & HR Club say, in this instance, you need to investigate whether the employee is in fact ill. If she isn't and she's forged the doctor's notes, take disciplinary action.

What's the charge?

In this article, we explained that if, after you've investigated, you find out the medical certificate is false or that your employee altered it, you must discipline your employee for misconduct.

'You can charge your employee with dishonesty because he willfully lied to you when he produced a false or altered medical certificate. You can also charge him with fraud because he produced the false or altered medical certificate to get sick pay to which he wasn't entitled.'

There's one more thing you need to do to break this trend and curb sick leave abuse…

Tell the employee who's taking two days' sick leave every month the following

In addition to taking disciplinary action against your employee, the experts recommend you warn your employee that this is now becoming a habitual problem. Warn him that this could lead to an incapacity process since it's affecting your business requirements.

It's that simple. If you have more questions regarding managing sick leave, sick leave or sick leave abuse, ask them here.
