Follow this process if SARS levies Vat penalties against you

Are you one of the many Vat vendors who think the only option they have is to sit back and grin and bear it when SARS levies Vat penalties?

You don't have to sit back when SARS slaps you with Vat penalties. Instead, follow this process...


Here's a process you can follow if you get hefty Vat penalties from SARS


If SARS levies Vat penalties against you, ask it to write off or reduce (remit) the penalties it's levied. Do this in writing and get it to SARS before the date you must pay the penalty.

You must use the Request for Remittance form to do this. You can submit the remittance form manually either via a branch or contact centre. If you like, you can also send the form in via post or at a drop off box at a branch.

So what should you include in your remittance request?

If SARS levies Vat penalties against you, ask it to remit the penalty and include the following in your request


The Practical Vat Loose Leaf Service says you must include:

  • A description of the circumstances that prevented you from complying with the relevant obligation under a tax Act; and
 
  • The supporting documents and information that SARS might need in the prescribed form.

When SARS receives your request, it'll look at it and inform you of its decision.

What happens if SARS refuses to remit your penalty?


If SARS decides to not remit or reduce your penalty, you can object to this decision. You can use the Notice of Objection ADR 1 form for your objection.

There you have it. You don't have to sit back when SARS slaps you with Vat penalties. Follow the process outlined above.
