Four instances when SARS will reduce or write off a fixed-amount administrative penalty

If you don't comply with the Vat Act, there are four penalties you'll be charged with. One of them is a fixed-amount administrative/non-compliance penalty.

The penalty's made up of:

1. Fixed amount-based penalties - these penalties will come your way when you don't comply with administrative obligations; and

2. Percentage-based penalties - SARS will impose these when you don't pay certain amounts of tax.

This penalty is serious because it means you'll have to fork out thousands of rand to SARS.

But it's not all doom and gloom when SARS hits you with this penalty. You can ask SARS to remit the penalty, especially if you got it because of circumstances beyond your control. Take a look at the four instances when SARS will reduce or write off a fixed-amount administrative penalty.

SARS can reduce a fixed-amount administrative penalty or write it off in these four in these four instances


According to the Practical Vat Loose Leaf Service, SARS can reduce a fixed-amount administrative penalty if:

#1: You didn't register for Vat;

#2: It's your first time being on the wrong side of Vat law;

#3: Exceptional circumstances exist, for example, the tax practitioner assisting you dropped dead; and

#4: There was no reason to impose the penalty in the first place.

So if SARS hits you with a fixed-amount administrative penalty, you can send an application to ask it to reduce it or write it off. SARS will then comply if your request meets the above conditions.
