If SARS refuses to give you a Vat refund, do THIS

Let's say, you do your calculations and you discover SARS owes you a Vat refund. You then submit your Vat refund return so SARS can give you money back. You do everything by the book and you make sure there are no outstanding tax issues.

After sometime, SARS notifies you that you won't get a Vat refund. What now? Do you have any recourse?

Yes you do.

Do the following if SARS refuses to give you a Vat refund


If SARS refuses to give you a Vat refund, object to or appeal the decision.

On its website, SARS explains that the objection must be in writing. You must complete the dispute resolution form (ADR 1 form).

You must clearly state why you're making the objection and give SARS all the relevant support documents so it can look into the matter.
Important: You have to make your objection within 30 business days from the date of the assessment.

What happens if SARS rejects your objection?

If SARS rejects your objection, you have a right to appeal.

Just like the objection, your appeal must be in writing, but this time around, you must complete the ADR 2 form.

You must lodge your appeal within 30 business days from the date of receiving notice of SARS's decision in respect of the objection.

SARS adds that on appeal indicate whether you wish to make use of the Alternative Dispute Resolution (ADR) procedures or rather appeal to the Special Board or Tax Court.

There you have it. You don't have to sit back when SARS refuses to give you a Vat refund, lodge an objection and if SARS rejects this, appeal. Just make sure you're absolutely sure of your facts before you object or make an appeal.
