Before we look at what you can do to enforce your rights, let's look at five instances when SARS can refuse your Vat registration


If you apply for voluntary Vat registration, SARS may refuse to register you in the following instances:
 

1. You have no fixed business or residential address;
 

2. You don't keep proper accounting records relating to any of your enterprises;
 

3. You haven't opened a banking account with a bank for the purpose of the business you're running;
 

4. You don't bring support documents with your VAT101 application form; and
 

5. You were previously registered as a vendor for any enterprise under the Vat Act and failed to perform your duties in terms of this Act.

Here's what to do if SARS refuses your Vat registration


If SARS refuses your Vat registration, it should supply you with the reasons for doing so in writing, says the Practical Vat Loose Leaf Service. So insist that SARS gives you reasons for turning you down.
 

Based on these reasons and if you feel you MUST register for Vat, you should then make an appointment with your SARS office to take this matter further (who knows, SARS may just reverse its decision.)
