Warning: COID will say your employee's accident was his fault in these four situations

The Compensation Commissioner is very strict about not giving compensation if your employee's accident was his fault.

The reason for this is it stops employees having injuries on purpose just so they can get compensation. Otherwise, a lot of people would have accidents, get compensation and then sit at home on the government's money.

But there are times your employee causes an accident without meaning to. In these situations, COID still won't give him compensation.

These are four such situations...

 

Four situations when COID will see your employee's accident as his own fault

 
1. If he's misbehaving
If your employee misbehaves, such as acting rowdy, and he causes an accident, it's his fault. After all, his careless behavior led to the accident.
 
2. If he's drunk
If your employee's drunk at work and has an accident because of it, it's his fault. If you notice any of your employees are drunk, you need to stop them for doing any dangerous work, send him home and discipline him accordingly.

3. If he ignores your safe working procedures
If you have clear safe working procedures and your employee ignores them, any accident will be his fault
 
4. If he uses machinery or equipment incorrectly despite knowing how to use it correctly
If your employee knows the right way to use his equipment and misuses it, which leads to an accident, it's his fault.
 
Remind your employees to work safely, correctly and effectively to ensure they don't have stupid accidents. 
 
The Compensation Commissioner will reject their injury claims if he finds out they caused their own accident.
 
This means they'll have an injury and won't get any help from COID.
