The Department of Labour said I could lose my business because of these two things!

by , 07 June 2013
Here's a question we received from one of our readers on the Health and Safety Club.

'The Department of Labour inspector called today, out of nowhere... They'll arrive in two weeks for a health and safety inspection. I don't have a Occupational Health and Safety file and I've never had a Risk Assessment done. The Department of Labour said I could lose my business and face heavy penalties or even imprisonment if I don't pass the inspection.'

Whether or not you're like this reader, the reality is that this can happen to you at any moment! Keep reading to find out how you can pass a DoL inspection!

Take this quick quiz to find out if you can handle the DoL hot seat
  • Which risk assessments have to be checked by an approved inspector every two years?
  • Is it absolutely necessary for your company to appoint and train someone as a risk assessor?
  • When was the last time you did a risk assessment? (Is that too long?)
  • Have you checked and double checked the less obvious health hazards?
If you can't answer even one of these questions you're not only putting your employee's lives at risk; you're also putting yourself in danger of massive fine from the DoL. Don't wait until it's too late.

  1. Ensure you have a SHE File that's fully updated with all the relevant information the DoL will look for.
  2. Conduct a risk assessment to find out what risks could harm your employees and how you'll prevent it.

When was the last time you did a risk assessment?
Did you double check the less obvious risks too? It's your legal obligation so there's no way to avoid doing it. I'm sure at some point you'll search online for a control measure that's easy to apply to solve your risk problem. But have you considered that you missed something last time? Perhaps you bought new machinery? Maybe your workers have been getting sick with the same ailment lately. You must prove you've done a risk assessment if you've had any of these changes in your workplace. Here's how you can do a risk assessment and prove to the DoL that you've complied with the law.
You must be on your guard all the time to ensure you're always 100% compliant. Even those who feel they're on top of things still get warnings and penalties from the DoL because they missed a couple of things! Many of our readers wrote back to say that the SHE File CD saved their businesses from closure and their necks from jail time! If it helped them, I know it'll help you too!
