Your employees have seven key rights to unionise. So be careful to not impose on them

Your employees have a constitutional right when it comes to freedom of association, and this translates into an undeniable right for them to join unions (an association of employees whose purpose is to manage relations between employees and employers).

This right applies to all workers, regardless of the size of your business. It even applies to an organisation which isn't a business.

Here are seven key rights your employees have to unionise:

1.      As was stated earlier, employees have an undeniable right to join trade unions.
 
2.      They have a right to attend union meetings.
 
3.      They can represent other workers in disciplinary hearings.

4.      They may be represented by a shop steward (a trade union representative) if there's one available.
 
5.      They can take part in protected strikes. This is a strike that doesn't involve essential services or designated maintenance services and that has gone through the correct pre-strike procedures.
 
6.      They have a right to participate in elections for shop stewards, officials and office bearers.
 
7.      Each employee has a right to stand for election, for appointment as a shop steward, official or office bearer.
 

Those were seven rights your employees have to form an alliance against you. So be careful not to obstruct them in any way. This can include you:

·        Harassing employees for making demands;
·        Victimising employees who are part of a trade union or who wish to join one; or
·        Discriminate, in any way, against an employee or job applicant because of trade union ties etc.
