The guideline was released on the 5th
of February 2016, in Government Gazette 39656, with the intention of further looking out for the health and safety of miners, in order to ensure compliance with the Mine Health and Safety Act (MHSA)
These guideline sets out to assist the employer in creating a Code of Practice (COP), after having had consulted the Health and Safety committee at the mine, so that it contains procedures for employees to exercise:
· The right of refusal to do dangerous work (RRDW); and
· The right to leave a dangerous working place (RLDWP).
The guideline makes reference to, among other things, the procedure for employees to follow when exercising RRDW and RLPWP.
It states, among other points, that…
The aim of the procedure should be to make sure that ALL circumstances which could cause an employee to exercise RRDW or RLDWP should be addressed, and that any disputes should be resolved as effectively and efficiently as possible;
The different steps of the procedure should have set time limits within which the steps should be taken;
The persons who'll be potentially involved in each step should be clearly identified; and that
Where it's appropriate, the procedure could describe HOW a step should be done in exercising RRWD RLDWP…

: The MHSA requires the employer to create and implement a COP for any issue concerning the health and safety of the employees or anyone directly affected. And failure to comply with this guideline is in breach of the MHSA.
